Robert C. Robert’s practice balances a high volume creditor practice with hands-on trial litigation, giving clients an efficient, cost effective way to pursue matters knowing they are in the hands of a capable and willing litigator when challenges arise.

Litigation Experience

  • Obtained favorable jury verdicts on a variety of claims including:
    • commercial contractor facing claims of inferior workmanship;
    • manufacturing supplier defending claims of defective product;
    • commercial leasing company facing claim of fraudulent inducement to contract;
    • realtor facing claim of professional negligence.
  • Successfully defended realtor on claim of breach of fiduciary duty; argued and prevailed before the Court of Appeals;
  • Obtained judgment in favor of regional bank regarding claims of lender liability related to financial package for houseboat manufacturer.

Creditor Rights/Bankruptcy

  • Represents local and national lenders in foreclosure and replevin cases statewide, including manufactured housing cases;
  • Represents creditors in filing and negotiating claims in Chapter 13 cases, obtaining orders for stay of relief, litigating and trying actions for dischargability;
  • Represents individual debtors in Chapter 7 and 13 bankruptcy cases.

Real Estate

  • Provides full service title and closing services for in-house and secondary market lenders on residential and commercial transactions;
  • Provides opinion of title for surface and mineral rights;
  • Litigates contract and boundary disputes.

Estate Planning/Probate

  • Provides comprehensive estate planning for individual clients seeking wills and trusts for succession and estate tax planning;
